Многоуважаемый господин государственный министр!
Обращаюсь
к Вам с этим посланием, учитывая, что сфера правосудия в Республике Арцах
входит в Вашу компетенцию и Вы не раз говорили о необходимости восстановления
законности и атмосферы справедливости.
Довожу
до Вашего сведения, что представители Полиции Арцаха, без санкции Прокуратуры
РА, произвели у меня в квартире незаконный обыск, в результате которого они,
цитирую, «арестовали 2 номера газет», в которых я работал. В тот же день меня
пригласили «на собеседование» в Полицию РА, где неожиданно, не предъявив никаких
обвинений, задержали и отвезли в Степанакертский изолятор временного
содержания. На 4-е сутки, до суда и оглашения приговора, ко мне ночью в камеру
ворвались 4 спецназовцев в масках, скрутили мне руки и, надев на меня наручники
и мешочек на голову, отвезли в Шушинскую тюрьму, где я и узнал, что арестован
по обвинению в клевете на власти Карабаха. По одной газетной публикации против
меня было возбуждено два (!) уголовных дела - факт, не виданный даже в самых
отсталых государствах мира.
Конкретной
причиной незаконного ареста, уголовного дела, а впоследствии и незаконного
решения суда стала моя статья «Для простых граждан в бюджете денег нет», в
которой я описал мучения 30 семей крестьян, которых лишили льгот,
предусмотренных специальным постановлением Правительства НКР. Правоохранители и
председатель горсуда посчитали это клеветой в адрес властей, заявив, что они
проверили, что этих крестьян в природе не существует. Спустя несколько дней
крестьяне выступили в печати с заявлением, оповестив общественность и власти о
том, что они не только существуют, но и готовы выступить свидетелями на суде.
Председатель
горсуда отказался выслушать свидетелей – без объяснений своего незаконного
решения, без всяких оснований, грубо нарушив законодательство НКР. Вам известно
также, что я был приговорен к 1 году тюремного заключения, которое было
заменено на год условного тюремного заключения с двухгодичным испытательным
сроком. Несмотря на то, что власти НКР были предупреждены мной и членами моей
семьи о тяжелой сердечной болезни моей матери – Розы Аветисян, о курсе лечения,
которое она в тот момент проходила, несмотря на то, что мы просили власти
отсрочить оглашение незаконного приговора, поскольку это может привести к
трагическим последствиям, председатель горсуда и другие официальные лица
все-таки приняли решение довести свое преступление до конца – приговор был
вынесен и оглашен. В результате бесчеловечного решения моя мать скончалась от
острой сердечной недостаточности.
Господин
госминистр!
Занимая
должность руководителя Службы национальной безопасности НКР, Бако Саакян при
нашей встрече заявил мне, что власти допустили несправедливость по отношению ко
мне. Те же самые слова сказал мне Аркадий Гукасян, бывший в то время
президентом НКР и признавший вину властей в этом деле тоже при нашей встрече.
Сложилась странная ситуация: два
президента НКР признали мою невиновность, а незаконное решение суда до сих пор
не пересмотрено, равно как и не возмещен ущерб, понесенный мной и моей семьей в
результате незаконных решений правоохранительных органов Карабаха.
В
ходе своих антиконституционных действий власти нарушили, как минимум, четыре
статьи Уголовного Кодекса НКР. Это статьи УК № 348 (Незаконное задержание и
незаконный арест), № 352 (Незаконный приговор суда), № 308
(Злоупотребление служебным положением) и № 359 действовавшего тогда
УПК НКР, в которой говорилось: «…если приговор суда может повлечь за
собой особо тяжкие последствия для осужденного или членов его семьи, он должен
быть отложен». Последняя статья применяется даже к опасным преступникам. А ведь
в моем случае речь шла о журналисте, безвинно осужденном человеке. Я уж не
говорю о других мелких и крупных правонарушениях (издевательское отношение в
тюрьме, запугивания, принуждение к лжесвидетельству и т.д.). И всё это за то,
что я в своей статье попытался защитить права группы несчастных, обездоленных
крестьян, которых власти довели до неописуемого отчаяния…
Господин
госминистр!
По
отношению ко мне и членам моей семьи совершена чудовищная несправедливость,
вызвавшая осуждение не только СМИ и правозащитных организаций 39 государства
мира, но даже тех, кто ее осуществил. Преступление властей РА осудили сотни СМИ
и практически все правозащитные организаций мира, в том числе Комитет по
протекции журналистов (США), Репортеры без границ (Франция), Эмнисти
интернейшнл (Великобритания) и многие-многие другие структуры, даже Союз
журналистов России (!). В Европе автор этих строк объявлен «узником совести». В
результате мощной международной волны протеста тюремное заключение было заменено
годом условного заключения с двухгодичным испытательным сроком.
Долгое
время моя семья терпеливо ждала восстановления справедливости и элементарной
законности в этом деле, но так ее и не дождалась, несмотря на то, что Карабах в
своей Конституции заявляет о провозглашении курса на демократизацию и создание
правового государства. Мы обратились с протестом в Прокуратуру НКР с
требованием пересмотреть незаконное решение карабахского суда. Прокуратура НКР
заявила нам, что приговор должен пересмотреть Кассационный суд НКР. Обратились
в Кассационный суд. Там нам заявили, что приговор должна пересмотреть
Прокуратура НКР. Между двумя госструктурами НКР возник спор, длящийся уже годы.
Решить эту проблему должны Вы – куратор сферы правосудия и один из конституционных
гарантов наших прав.

В
ходе предвыборной кампании руководители Карабаха не раз говорили об укреплении
законности в Нагорном Карабахе. Но если мы не можем справедливо отнестись к
своим же гражданам, то какой справедливости мы требуем от Азербайджана, всего
остального мира? Всё, чего желает моя семья, это именно соблюдение законов НКР
в нашем деле со стороны правоохранительных органов НКР.
Все
очень просто: в своей статье я защитил права несчастных крестьян, доведенных до
отчаяния беззакониями некоторых властных структур НКР. Карабахский
суд объявил меня клеветником, заявив, что таких крестьян в природе не
существует и осудил меня, грубо поправ элементарнейшие требования закона.
Возмущенные этой ложью суда НКР, крестьяне выступили в прессе, заявив, что они
существуют и подтвердив правоту автора этих строк. Указанные факты подтверждены
документально – при необходимости готов предоставить Вам их копии.
Взывать
к христианским традициям, по которым прощают даже виновных, я не буду, потому
что не осталось человека, который не убедился бы в моей невиновности. Я взываю
только к соблюдению законности и надеюсь, что в Карабахе действуют хотя бы
законы Карабаха, если нормы международного права, видимо, уже не писаны для
нас. Призываю Вас обеспечить законность в описанном выше деле и не заставлять
нас доводить дело до международных судебных инстанций - этого наша семья не
желает, но даже нашему терпению настает конец.
Многоуважаемый Рубен Карленович!
Обратиться к Вам заставляет также
беспрецедентная ситуация, сложившаяся вокруг независимой армянской газеты
«Третья Сила Плюс» («ТСП»), незаконно закрытой усилиями ФСБ РФ. Газета была
открыта по совместной инициативе известного московского мецената Левона
Айрапетяна, трагически скончавшегося недавно в мордовской тюрьме РФ, и автора
этих строк.
Сообщаю Вам, что значительная часть
финансовых средств нашего издания, хранившаяся в московском «Альфа-банке», без
всякого официального или неофициального объяснения, была незаконно присвоена со
стороны ФСБ, в результате чего газета вынуждена была приостановить свою
деятельность. Подполковник ФСБ Вадим Поздышев, укравший журналистские
сбережения,
явно взят под покровительство
руководством этого ведомства, хотя вина его в этом преступлении доказана
многократно. Причем доказана до такой степени, что сама ФСБ вынуждена была
спешно уволить его со службы и, заметая следы, трудоустроить своего
проворовавшегося офицера в московской компании RBE GROUP (начальником аналитического отдела. Сейчас он переведен в другое
ведомство). Об этом «ТСП» сообщили домочадцы Поздышева — граждане России,
которые сами потрясены незаконными действиями своего родственника и полностью
поддерживают справедливые требования коллектива армянской газеты.
Выясняются новые подробности гнусной расправы, устроенной властями РФ над армянскими журналистами. Вот что рассказывает живущая в Москве родственница подполковника ФСБ — Елена Затонская, тоже гражданка РФ: «Однажды он явился к нам домой с большой суммой денег. На мой вопрос «Что это?», он сказал, что «Это деньги армян» и очень боялся обыска. Я призвала его немедленно отправить эти суммы журналистам. Он что-то невнятно пробормотал и, как я поняла, так и не выслал их по адресу. Спустя некоторое время его уволили из ФСБ за присвоение журналистских средств. Непосредственная начальница Поздышева в ФСБ — Гусева Елена Александровна — направила ему уведомление с приказом не выезжать за пределы Российской Федерации — то ли до 2015-го, то ли до 2017-го года». Госпожа Затонская в своем письме в редакцию «ТСП» призвала армянских журналистов обратиться к руководству ФСБ с призывом вернуть украденные газетные сбережения и выразила готовность оказать содействие в восстановлении справедливости и законности в этом позорном деле. Требования армянских журналистов настолько справедливы, а беззаконие по отношению к газете настолько беспрецедентно, что московские родственники вора — честные, порядочные граждане России — сами готовы отнести письма с протестом в ФСБ и другие госструктуры РФ.
Фактов по делу «ТСП» очень много, справиться
с его раскрытием в силах любой провинциальный участковый. Сохранились даже
письменные свидетельства самого преступника о воровстве (аж на 21-й странице).
Есть и другие, более важные документы. Более того: число доказательств преступления продолжает расти. И поступают они порой… даже от сотрудников
самой ФСБ.
Выясняется, что о скандале вокруг
закрытия «ТСП» проинформированы отделения ФСБ практически всех регионов России.
Родственник одного из офицеров-армян, служивших в ФСБ, на условиях анонимности
сообщил московским и тюменским источникам «ТСП», что «шум в Конторе очень
большой» и «по армянским деньгам уже возникает много вопросов». Многие офицеры
в недоумении: почему
Бортников (Директор ФСБ — В.А.) предпочитает «пачкать погоны
из-за одного проколовшегося отщепенца» и «воевать из-за него с журналистами»?
По некоторым сведениям, прикрывают вора не только в руководстве ФСБ, но и его
родственники в правящей партии «Единая Россия».
Но и это не все. Недавно в адрес главного редактора «ТСП» и журналистов издания поступило письмо от одного из высокопоставленных чиновников РФ, готовившего аналитические справки для Совета Безопасности России и в последнее время сменившего профиль своей деятельности. Зовут его Николай Романович Димлевич. Позже он был включен в рабочую группу Комитета по вопросам СНГ Госдумы РФ и иногда выступал в российском парламенте с докладами на тему, скажем, «Взаимоотношение РФ со странами СНГ в контексте «цветных революций», энергетических и иных проектов». Николаю Димлевичу звонят и из администрации президента РФ примерно по этим же проблемам, поскольку он считается профессионалом в вопросах геополитики.
Вашему вниманию представляем фрагмент его письма, адресованного главному редактору «ТСП» и сотрудникам издания: «Уважаемый Ваграм! Я искренне надеюсь, что Вам удастся добиться справедливости, хотя, как Вы понимаете, это довольно сложно. В любом случае, я желаю вам победы. По моим сведениям, В.П. (Вадим Поздышев — В.А.) уволен (из ФСБ) летом 2011 года. Его коллеги вряд ли будут выносить «сор из избы». Единственное, что вы можете сделать, это представить документы непосредственно на имя Директора того ведомства, где служил В.П. Обратиться к Директору проще простого. Есть несколько путей: через электронную почту на сайт (там и адрес есть в Москве), заказным письмом из своей страны, можно лично приехать и через приемную Директора (она находится на улице Кузнецкий мост) ПОД РАСПИСКУ(!!!) вручить пакет, где указать кому, от кого и по какому вопросу. Срок рассмотрения — 30 суток. Справедливость должна восторжествовать, а Зло — обязательно наказано. Вы — люди чести и я желаю вам удачи, успехов и веры. С искренним уважением Николай Димлевич».
Редакция армянской газеты, закрытой
усилиями властей России, последовала совету г-на Димлевича и отправила
Директору ФСБ Бортникову часть доказательств преступления, в том числе и
письменные свидетельства самого вора о краже журналистских средств. В ответ
поступило сообщение пресс-службы ФСБ о том, что «ФСБ прекращает переписку». Без
всяких объяснений и реакции на факт преступления...
Многоуважаемый Рубен Карленович!
В течение многих лет «ТСП» неоднократно
обращалась во все правовые инстанции Российской Федерации, но ни
Генпрокуратура, ни Следственный комитет, ни Военная прокуратура, ни тем более
ФСБ этой страны, в нарушение действующего законодательства РФ, не удосужились
хотя бы опросить свидетелей по данному делу, несмотря на многочисленные
обращения журналистов и готовность предоставить все доказательства хищения
газетных средств. Видимость какого-то расследования пыталось создать только
МВД РФ, но после тяжких трехмесячных раздумий решило передать дело в ФСБ,
сославшись на его «особую важность».
Весьма своеобразно среагировала сама
ФСБ. Уже бывший начальник ЦОС этого ведомства господин Захаров, в ответ на
протесты «ТСП», цинично заявил, что ФСБ прекращает переписку по этому делу –
ничего не объясняя и не сообщая, когда журналисты, наконец, получат украденные
средства. Руководитель любого ведомства вроде бы должен заинтересоваться и
среагировать на многочисленные письменные протесты журналистов и, как минимум,
провести хотя бы формальное расследование, как этого требует законодательство
даже самых отсталых государств мира. Но директор ФСБ А. Бортников не расследует
дело, а кто-то «таинственным» образом блокирует письма журналистов президенту
РФ В. Путину. Хотелось бы знать, почему…
Редакция «ТСП» получила также письмо
Министерства иностранных дел России, которое призвало армянских журналистов
обратиться… в
правоохранительные органы почему-то Армении. «ТСП», естественно, не последовала
совету МИД РФ – по той простой причине, что это ведомство демонстрирует
абсолютное незнание элементарных норм юриспруденции: правоохранительные органы Армении, даже при большом
желании, не могут рассмотреть указанное дело. Поскольку преступление
против газеты совершено на территории Российской Федерации, а преступник –
подполковник ФСБ РФ Вадим Поздышев – является гражданином России, армянский суд
не правомочен рассматривать правонарушения иностранцев, совершенные в других
государствах. В данной ситуации это могут сделать только правоохранительные
органы России, которые откровенно прикрывают преступника. А МИД этой страны,
судя по всему, пытается направить гнев армянских журналистов против властей
Армении, понимая, что в ходе расследования преступления в РФ дело получит
общественный резонанс, и всплывут весьма и весьма скандальные подробности
беззаконий и многолетних издевательств ФСБ над армянским изданием. А может – и
более серьезные обстоятельства…
Уважаемый господин госминистр!
Всё всем понятно в этом деле. Известен
преступник – подполковник ФСБ Вадим Поздышев. Известно, сколько денег он украл
у журналистов, вследствие чего газета закрылась. Известно, где он прятал
украденную сумму. Известно, когда и почему его спешно «уволили» из ФСБ, быстро
трудоустроив в другом ведомстве. Неизвестно другое: почему власти Российской Федерации и, в первую очередь, ФСБ
РФ, периодически выступающие с заявлениями о братских и союзнических отношениях
с армянским народом, прикрывают преступника, ограбившего граждан братской
страны? Только потому, что он – офицер ФСБ, а пострадавшие – армяне и
журналисты?
Несмотря на справедливость и законность
наших требований, власти Российской Федерации в лице Директора ФСБ А.В.
Бортникова отказывают нам в праве на эелементарное правосудие и, откровенно
взяв под защиту своего проворовавшегося сотрудника, укравшего газетные
сбережения – подполковника ФСБ Поздышева В.В., делают все возможное, чтобы
расследование по факту данного преступления не началось. Руководство ФСБ
прекрасно сознает, что суд заставит их вернуть журналистам украденные у них
финансовые средства, поэтому всячески торпедирует процесс расследования дела.
Уважаемый господин Варданян!
Как гражданин Республики Арцах, как
главный редактор незаконно закрытого независимого издания, исходя из
вышеизложенного, прошу Вашего содействия в восстановлении законности в
описанном деле и прав сотрудников интернационального коллектива издания. Все,
что мы требуем, это простое, законное расследование факта преступления,
совершенного против нашей газеты. Но нас лишают даже этого права – то ли по
политическим, то ли по националистическим, то ли по каким-то другим, только им
ведомым причинам. Если редакция «ТСП» не права в своих требованиях, она готова
принести публичные извинения перед общественностью двух стран и даже понести за
это соответствующую ответственность. Если же права, то она требует вернуть
финансовые средства «ТСП», украденные российским чиновником. Отмечаю особо, что
практически все наши утверждения подкреплены документально, на фактической
основе. Заранее благодарю Вас за содействие в деле защиты прав журналистов
нашего издания.

Despite the blockade of the population of Nagorno-Karabakh, arranged by the Azerbaijani authorities and Russian "peacekeepers", the Karabakh authorities are not taking any serious measures to alleviate the difficult socio-economic situation in the second Armenian republic. The same cosmic prices for food and basic necessities, the same delays of caricaturally low salaries and pensions, the same merciless robbery of the NKR citizens. No benefits for the citizens of Karabakh, no pity for their compatriots who are going through the hardest times, no preferences and elementary humanity! The cruelty of the NK authorities towards a handful of Armenians, who by some miracle still inhabit Artsakh, simply amazes the imagination and leads to certain reflections - more and more NK citizens come to the opinion that the NK and RA authorities are simply fulfilling an external order to dearmenize the region.
Apart from the Karabakh officials is NK State Minister Ruben Vardanyan, who solemnly promises to improve the situation in NK, ensure an atmosphere of justice in the republic, and so on. However, there are still no changes in Artsakh - the same lawlessness, the same arbitrariness towards the citizens of NK who have endured unimaginable trials and hardships during the 34-year conflict. More and more Karabakh experts and observers, so far cautiously, but gradually tend to think that the statements of the NKR State Minister are generally populist in nature. In any case, the Armenian public has not yet observed any concrete steps to improve the situation in NK.
It seems that Ruben Vardanyan sometimes refuses even his own intentions and publicly announced initiatives. For example, not so long ago Mr. Vardanyan sent a letter to the editor-in-chief of the independent Armenian newspaper "Third Force Plus" Vahram Aghajanyan (see below). It should be recalled that the newspaper was opened on the joint initiative of the famous Karabakh philanthropist Levon Hayrapetyan and journalist Vahram Aghajanyan and was illegally closed by the FSB of Russia and their henchmen in Armenia and NK. Representatives of the closed newspaper did not address Mr. Vardanyan - he himself sent a letter to the editor-in-chief on the Linkedin social network. But after sitting in the chair of the NKR State Minister, Mr. Vardanyan seems to have somewhat forgotten about his good intentions and his own statements on improving the situation in Artsakh.
Nevertheless, as law-abiding citizens who trust their leaders, we have sent a reply message to the NKR State Minister, with an appeal to contribute to the restoration of legality in at least one specific case. We dare to hope that Mr. Vardanyan is faithful to his own promises and assurances regarding the future of Artsakh, its struggle for freedom, independence and justice. Copies of our message have been sent to all our colleagues in 17 countries of the world, to all journalistic and human rights organizations, diplomatic missions in Armenia, the OSCE and the UN.

Dear Mr. Minister of State,
I am addressing you with this message, considering that the sphere of justice in the Republic of Artsakh is within your competence and you have repeatedly spoken about the need to restore legality and an atmosphere of justice.
I bring to your attention that representatives of the Artsakh Police, without the authorization of the RA Prosecutor's Office, conducted an illegal search in my apartment, as a result of which they, quote, "arrested 2 issues of newspapers" in which I worked. On the same day, I was invited "for an interview" with the RA Police, where unexpectedly, without bringing any charges, I was detained and taken to the Stepanakert temporary detention center. On the 4th day, before the trial and the announcement of the verdict, 4 masked commandos burst into my cell at night, twisted my hands and, putting handcuffs on me and a bag on my head, took me to Shusha prison, where I found out that I had been arrested on charges of slandering the authorities of Karabakh. According to one newspaper publication, two (!) criminal cases were initiated against me - a fact not seen even in the most backward states of the world.
The specific reason for the illegal arrest, criminal case, and subsequently illegal court decision was my article "There is no money in the budget for ordinary citizens", in which I described the torment of 30 peasant families who were deprived of benefits provided for by a special decree of the NKR Government. Law enforcement officers and the chairman of the City Court considered this a slander against the authorities, saying that they had checked that these peasants did not exist in nature. A few days later, the peasants made a statement in the press, informing the public and the authorities that they not only exist, but are also ready to act as witnesses at the trial.
The chairman of the City Court refused to listen to the witnesses – without explaining his illegal decision, without any grounds, grossly violating the legislation of the NKR. You also know that I was sentenced to 1 year in prison, which was replaced by a year of suspended imprisonment with a two-year probation period. Despite the fact that the NKR authorities were warned by me and my family members about the serious heart disease of my mother, Rosa Avetisyan, about the course of treatment she was undergoing at that moment, despite the fact that we asked the authorities to postpone the announcement of the illegal verdict, as it could lead to tragic consequences, the chairman of the City Court and others the officials still decided to bring their crime to an end - the verdict was pronounced and announced. As a result of the inhumane decision, my mother died of acute heart failure.
Mr. Minister of State!
Holding the position of head of the NKR National Security Service, Bako Sahakyan told me at our meeting that the authorities had committed injustice towards me. Arkady Ghukasyan, who was the president of the NKR at that time and admitted the guilt of the authorities in this case, also said the same words to me at our meeting. A strange situation has developed: two NKR presidents have recognized my innocence, and the illegal court decision has not yet been reviewed, as well as the damage suffered by me and my family as a result of illegal decisions of the Karabakh law enforcement agencies has not been compensated.
In the course of their unconstitutional actions, the authorities violated at least four articles of the NKR Criminal Code. These are articles of the Criminal Code No. 348 (Illegal detention and illegal Arrest), No. 352 (Illegal Court Verdict), No. 308 (Abuse of official position) and No. 359 of the NKR Criminal Procedure Code in force at that time, which stated: "... if the court verdict may entail particularly grave consequences for the convicted person or his family members, he should be postponed." The latter article applies even to dangerous criminals. But in my case it was about a journalist, an innocent convicted person. I'm not talking about other minor and major offenses (bullying in prison, intimidation, coercion to perjury, etc.). A monstrous injustice has been committed against me and my family members, which has caused condemnation not only by the media and human rights organizations of 39 countries of the world, but even by those who carried it out. The crime of the RA authorities was condemned by hundreds of media outlets and almost all human rights organizations in the world, including the Committee for the Protection of Journalists (USA), Reporters Without Borders (France), Amnesty International (UK) and many, many other structures, even the Union of Journalists of Russia (!). In Europe, the author of these lines is declared a "prisoner of conscience". As a result of a powerful international wave of protest, the prison sentence was replaced by a year of probation with a two-year probation period.
For a long time, my family patiently waited for the restoration of justice and elementary legality in this case, but it never came, despite the fact that Karabakh declares in its Constitution the proclamation of a course towards democratization and the creation of a rule of law state. We have appealed to the NKR Prosecutor's Office with a demand to review the illegal decision of the Karabakh court. The NKR Prosecutor's Office told us that the verdict should be reviewed by the NKR Court of Cassation. They appealed to the Court of Cassation. They told us that the verdict should be reviewed by the NKR Prosecutor's Office. A dispute has arisen between the two state structures of the NKR, which has been going on for years. You, the curator of the justice sector and one of the constitutional guarantors of our rights, must solve this problem.

During the election campaign, the leaders of Karabakh have repeatedly talked about strengthening the rule of law in Nagorno-Karabakh. But if we cannot treat our own citizens fairly, then what kind of justice do we demand from Azerbaijan and the rest of the world? All that my family wants is compliance with the laws of the NKR in our business by the NKR law enforcement agencies.
It's very simple: in my article, I defended the rights of unfortunate peasants driven to despair by the lawlessness of some power structures of the NKR. The Karabakh court declared me a slanderer, stating that such peasants do not exist in nature and condemned me, roughly correcting the most elementary requirements of the law. Outraged by this lie of the NKR court, the peasants appeared in the press, stating that they exist and confirming the correctness of the author of these lines. These facts are documented – if necessary, I am ready to provide you with copies of them.
I will not appeal to Christian traditions, according to which even the guilty are forgiven, because there is no one left who would not be convinced of my innocence. I appeal only to the rule of law and hope that at least the laws of Karabakh are in force in Karabakh, if the norms of international law are apparently no longer written for us. I urge you to ensure the legality of the case described above and not to force us to bring the case to international courts - our family does not want this, but even our patience is coming to an end.

The unprecedented situation that has developed around the independent Armenian newspaper "Third Force Plus" ("TFP"), illegally closed by the efforts of the Federal Security Service (FSS) of the Russian Federation, also makes me turn to you. The newspaper was opened on the joint initiative of the famous Moscow philanthropist Levon Hayrapetyan, who tragically died recently in the Mordovian prison of the Russian Federation, and the author of these lines.
I inform you that a significant part of the financial resources of our publication, stored in the Moscow Alfa-Bank, without any official or unofficial explanation, was illegally appropriated by the FSS, as a result of which the newspaper was forced to suspend its activities. FSS Lieutenant Colonel Vadim Pozdyshev, who stole journalistic savings,
clearly taken under the patronage of the leadership of this department, although his guilt in this crime has been proven many times. Moreover, it was proved to such an extent that the FSS itself was forced to hastily dismiss him from the service and, covering its tracks, employ its embezzled officer in the Moscow company RBE GROUP (head of the analytical department. He has now been transferred to another department). This was reported to "TFP" by Pozdyshev's household — citizens of Russia, who themselves are shocked by the illegal actions of their relative and fully support the just demands of the Armenian newspaper's staff.
New details of the heinous massacre of Armenian journalists by the Russian authorities are being clarified. Here is what a relative of the FSS lieutenant colonel living in Moscow, Elena Zatonskaya, also a citizen of the Russian Federation, says: "One day he came to our house with a large sum of money. To my question "What is it?", he said that "It is Armenian money" and was very afraid of a search. I urged him to immediately send these amounts to journalists. He muttered something indistinctly and, as I understood, did not send them to the address. Some time later, he was fired from the FSS for embezzling journalistic funds. Pozdyshev's immediate supervisor in the FSS, Elena Guseva, sent him a notification with an order not to leave the Russian Federation — either until 2015, or until 2017". Ms. Zatonskaya, in her letter to the "TFP" editorial office, called on Armenian journalists to appeal to the FSS leadership to return the stolen newspaper savings and expressed readiness to assist in restoring justice and legality in this shameful case. The demands of Armenian journalists are so fair, and the lawlessness towards the newspaper is so unprecedented that the thief's Moscow relatives — honest, decent citizens of Russia — are themselves ready to take letters of protest to the FSS and other state structures of the Russian Federation.
There are a lot of facts about the "TSP" case, any provincial precinct officer can cope with its disclosure. Even the written evidence of the criminal himself about the theft has been preserved (already on page 21). There are other, more important documents. Moreover, the number of evidence of the crime continues to grow. And they sometimes come... even from employees of the FSS itself.
It turns out that the FSS offices of almost all regions of Russia have been informed about the scandal surrounding the closure of TSP. A relative of one of the Armenian officers who served in the FSS, on condition of anonymity, told TSP's Moscow and Tyumen sources that "the noise in the Office is very big" and "there are already many questions about Armenian money." Many officers are at a loss: why does Bortnikov (FSS Director — V.A.) prefer to "dirty shoulder straps because of one punctured renegade" and "fight with journalists because of him"? According to some reports, the thief is being covered not only by the FSS leadership, but also by his relatives in the ruling United Russia party.
But that's not all. Recently, the editor-in-chief of "TFP" and the journalists of the publication received a letter from one of the high-ranking officials of the Russian Federation, who prepared analytical reports for the Russian Security Council and recently changed the profile of his activities. His name is Nikolai Romanovich Dimlevich. Later, he was included in the working group of the Committee on CIS Issues of the State Duma of the Russian Federation and sometimes made reports in the Russian Parliament on, say, "The relationship of the Russian Federation with the CIS countries in the context of "color revolutions", energy and other projects". Nikolai Dimlevich also receives calls from the presidential administration of the Russian Federation about the same problems, since he is considered a professional in matters of geopolitics.
We present to your attention a fragment of his letter addressed to the editor-in-chief of "TFP" and the staff of the publication: "Dear Vagram! I sincerely hope that you will be able to achieve justice, although, as you understand, it is quite difficult. In any case, I wish you victory. According to my information, V.P. (Vadim Pozdyshev — V.A.) was dismissed (from the FSS) in the summer of 2011. His colleagues are unlikely to take out "rubbish from the hut". The only thing you can do is to submit documents directly to the Director of the department where V.P. served. It's easy to contact the Director. There are several ways: via e-mail to the website (there is also an address in Moscow), by registered mail from your country, you can personally come through the Director's reception (it is located on Kuznetsky Most Street) ON RECEIPT (!!!) to hand over the package, where to indicate to whom, from whom and on what issue. The review period is 30 days. Justice must prevail, and Evil must be punished. You are people of honor and I wish you good luck, success and faith. Sincerely yours, Nikolai Dimlevich".
The editorial office of the Armenian newspaper, closed by the efforts of the Russian authorities, followed Mr. Dimlevich's advice and sent the FSB Director Bortnikov part of the evidence of the crime, including the written testimony of the thief himself about the theft of journalistic funds. In response, the FSB press service reported that "the FSB stops correspondence". Without any explanation or reaction to the fact of the crime...

For many years, "TFP" has repeatedly appealed to all legal authorities of the Russian Federation, but neither the Prosecutor General's Office, nor the Investigative Committee, nor the Military Prosecutor's Office, nor the FSS of this country, in violation of the current legislation of the Russian Federation, have bothered to at least interview witnesses in this case, despite numerous appeals from journalists and willingness to provide everything evidence of theft of newspaper funds. Only the Ministry of Internal Affairs of the Russian Federation tried to create the appearance of some kind of investigation, but after serious three months of reflection decided to transfer the case to the FSS, citing its "special importance".
The FSS itself reacted in a very peculiar way. Already the former head of the DSP of this department, Mr. Zakharov, in response to the protests of the "TFP", cynically stated that the FSS stops correspondence on this case – without explaining anything and without informing when the journalists will finally receive the stolen funds. The head of any department seems to be interested and react to the numerous written protests of journalists and, at least, conduct at least a formal investigation, as required by the legislation of even the most backward states of the world. But the director of the FSS A. Bortnikov is not investigating the case, and someone "mysteriously" blocks the letters of journalists to the President of the Russian Federation V. Putin. I would like to know why…
The editorial board of "TFP" also received a letter from the Ministry of Foreign Affairs of Russia, which called on Armenian journalists to contact... the law enforcement agencies of Armenia for some reason. "TFP", of course, did not follow the advice of the Ministry of Foreign Affairs of the Russian Federation – for the simple reason that this department demonstrates absolute ignorance of elementary norms of jurisprudence: law enforcement agencies of Armenia, even with a strong desire, cannot consider the case. Since the crime against the newspaper was committed on the territory of the Russian Federation, and the criminal – Lieutenant Colonel of the FSS of the Russian Federation Vadim Pozdyshev – is a citizen of Russia, the Armenian court is not authorized to consider the offenses of foreigners committed in other states. In this situation, this can only be done by the law enforcement agencies of Russia, which openly cover the criminal. And the Foreign Ministry of this country, apparently, is trying to direct the anger of Armenian journalists against the Armenian authorities, realizing that during the investigation of the crime in the Russian Federation, the case will receive a public response, and very, very scandalous details of the lawlessness and long-term mockery of the FSS over the Armenian publication will emerge. And maybe even more serious circumstances…
Dear Mr. Minister of State!
Everything is clear to everyone in this case. A known criminal is FSS Lieutenant Colonel Vadim Pozdyshev. It is known how much money he stole from journalists, as a result of which the newspaper was closed. It is known where he hid the stolen amount. It is known when and why he was hastily "fired" from the FSB, quickly finding a job in another department. Another thing is unknown: why do the authorities of the Russian Federation and, first of all, the FSS of the Russian Federation, who periodically make statements about fraternal and allied relations with the Armenian people, cover up a criminal who robbed citizens of a fraternal country? Just because he is an FSS officer and the victims are Armenians and journalists?
Despite the fairness and legality of our demands, the authorities of the Russian Federation, represented by the Director of the FSS A.V. Bortnikov, deny us the right to elementary justice and, frankly taking under the protection of their embezzled employee who stole newspaper savings – FSS Lieutenant Colonel Pozdyshev V.V., do everything possible so that the investigation into this crime does not begin. The FSS leadership is well aware that the court will force them to return the stolen funds to the journalists, so it torpedoes the investigation process in every possible way.

As a citizen of the Republic of Artsakh, as the editor-in-chief of an illegally closed independent publication, proceeding from the above, I ask for your assistance in restoring legality in the described case and the rights of employees of the international collective of the publication. All we demand is a simple, legitimate investigation into the fact of a crime committed against our newspaper. But we are being deprived even of this right – either for political, nationalist, or for some other reasons only they know. If the editorial board of "TFP" is wrong in its demands, it is ready to make a public apology to the public of the two countries and even bear appropriate responsibility for it. If she is right, then she demands to return the funds of "TFP" stolen by a Russian official. I especially note that almost all of our statements are documented, on a factual basis. Thank you in advance for your assistance in protecting the rights of journalists of our newspaper.
